📄 User Agreement

1. 📄 General Provisions

This application is a digital lifestyle tool designed for visual smile analysis, oral care tips, and educational content.

It is not a medical device and does not provide diagnosis, treatment, or professional medical consultation.

By using the App, the User fully and unconditionally accepts the terms of this Agreement.

2. 👥 Rights and Obligations

• The User agrees to use the App solely for personal, non-commercial purposes.
• Copying, distributing, modifying, or using any materials beyond what is permitted under this Agreement is strictly prohibited.
• The Developer grants access to the App’s functionality and may update features, design, or terms without prior notice.
• The User is responsible for reviewing updates. Continued use constitutes acceptance of revised terms.
• Automated access, scraping, or use of the App’s content for machine learning or commercial datasets is strictly prohibited.

3. ⚠️ Limitation of Liability

• All recommendations and content are for informational purposes only.
• The Developer is not liable for any decisions made by the User based on the App’s content.
• The App does not replace consultation with licensed professionals.
• The Developer is not responsible for technical issues, device incompatibility, or data loss.
• Any visual suggestions or AI-generated highlights are not diagnostic and must not be interpreted as medical advice.

4. 🔐 Privacy

• The Developer adheres to international data protection standards, including GDPR, CCPA, and PIPEDA.
• All personal data is processed in accordance with the Privacy Policy.
• Payment information is handled exclusively by Paddle.com. The Developer does not store or process billing data.
• The App does not collect or process sensitive personal data, including health, biometric, or geolocation information.
• Users may request deletion of their personal data by contacting support.

5. 📍 Governing Law

This Agreement is governed by the laws of the Province of Alberta, Canada.

Any disputes shall be resolved in the courts of Alberta.

Where applicable, international data protection laws shall be considered in interpretation.

6. ⚠️ Electronic Consent

By using the App or website, the User agrees that all legal notices, updates, and agreements may be provided electronically.

The User waives the right to receive paper copies unless required by law.

By using the App, the User consents to the processing of their data as described in this Agreement and the Privacy Policy.

7. 🔁 Refunds and Cancellations

• All purchases are processed by Paddle.com, our authorized reseller and Merchant of Record.
• Refunds are subject to Paddle’s refund policy.
• Users may request a refund in case of technical issues, non-delivery, or if the product does not match its description.
• The Developer does not directly process refunds.

8. ✅ Final Clauses

• This Agreement may be updated by the Developer.
• The current version is always available in the App and on the website.
• Users will be notified of material changes. Continued use after updates constitutes acceptance.
• If any provision is deemed invalid, the remaining provisions shall remain in full effect.
• This Agreement is executed in English. Translations are provided for convenience only. In case of discrepancies, the English version shall prevail.
